Un peu comme l&rsquo;ancien!"},"content":{"rendered":"<p><em>Par Ivana Saula, <\/em><br \/>\n<em>directrice de la recherche, Canada<\/em><\/p>\n<p>Alors que les syndicats s&rsquo;appr\u00eataient \u00e0 c\u00e9l\u00e9brer la f\u00eate du Travail, le gouvernement f\u00e9d\u00e9ral a annonc\u00e9 la mise en \u0153uvre de plusieurs modifications au Code canadien du travail. Le gouvernement f\u00e9d\u00e9ral a annonc\u00e9 aujourd&rsquo;hui la mise en \u0153uvre de modifications au Code canadien du travail. Au contraire, le gouvernement f\u00e9d\u00e9ral lib\u00e9ral a d\u00e9montr\u00e9 son id\u00e9ologie en refusant de moderniser v\u00e9ritablement le <em>Code<\/em>. Malgr\u00e9 les consultations avec les syndicats et en d\u00e9pit des objections soulev\u00e9es par plusieurs d&rsquo;entre eux, les lib\u00e9raux sont rest\u00e9s sourds aux persuasions d\u2019\u00e9quit\u00e9 et de justice. Les consultations qui ont dur\u00e9 des mois ne sont que du tape-\u00e0-l\u2019\u0153il et qu\u2019une fa\u00e7ade, donnant l\u2019impression que les lib\u00e9raux sont du c\u00f4t\u00e9 des travailleurs. Malheureusement, c\u2019est une occasion manqu\u00e9e.<\/p>\n<p>Alors, \u00e0 quoi ressemble un <em>Code<\/em> \u00ab modernis\u00e9 \u00bb?<\/p>\n<p>Tout d\u2019abord, une disposition pr\u00e9voyant des pauses obligatoires de 30 minutes pour chaque tranche de cinq heures travaill\u00e9es ne changera rien pour la majorit\u00e9 des salari\u00e9s. Plusieurs employeurs ont demand\u00e9 des exemptions et les ont obtenues sans trop d&rsquo;opposition de la part du gouvernement f\u00e9d\u00e9ral, excluant ainsi les travailleurs d\u2019un certain nombre de dispositions. Sans compter que le nouveau syst\u00e8me de quarts de travail fractionn\u00e9s qui a \u00e9t\u00e9 propos\u00e9 n\u2019a m\u00eame pas \u00e9t\u00e9 abord\u00e9. 2. Les quarts de travail fractionn\u00e9s sont des types d&rsquo;horaires dans lesquels un quart de travail est divis\u00e9 en deux ou plusieurs quarts de travail.<\/p>\n<p>Il existe \u00e9galement une exigence imposant des p\u00e9riodes de repos de huit heures entre les quarts de travail pr\u00e9vus \u00e0 l\u2019horaire. Mais, en raison des exemptions engag\u00e9es \u00e0 l\u2019initiative des employeurs, de nombreux travailleurs ne seront pas vis\u00e9s par cette disposition. Cela signifie que dans les industries o\u00f9 les employeurs ont obtenu une exemption, les quarts de travail peuvent \u00eatre \u00e9tablis \u00e0 des intervalles de moins de huit heures. Dans la plupart des cas, cela s\u2019av\u00e9rerait n\u00e9cessaire lorsqu\u2019il n\u2019y a pas suffisamment de personnel pour pourvoir les quarts de travail et que, plut\u00f4t que de doter les postes de mani\u00e8re ad\u00e9quate, le gouvernement f\u00e9d\u00e9ral permet aux employeurs de surmener les salari\u00e9s. Le Code \u00a0\u00ab modernis\u00e9 \u00bb supprime un droit fondamental, une norme mondiale, qui est de huit heures de repos. Le mouvement des journ\u00e9es de huit heures par jour est n\u00e9 en 1817 et, en 2019, certains travailleurs canadiens n&rsquo;y auront toujours pas droit.<\/p>\n<p>Le cong\u00e9 pour obligations familiales s&rsquo;applique de fa\u00e7on g\u00e9n\u00e9rale, cependant, non sans limitations et charges impos\u00e9es aux travailleurs. En particulier, les chefs de famille monoparentale, ceux qui s&rsquo;installent dans de nouvelles villes sans soutien familial et les nouveaux arrivants seront ceux qui supporteront le plus lourd fardeau. Le gouvernement f\u00e9d\u00e9ral argue qu\u2019afin de pr\u00e9venir tout abus de cette disposition, sans fournir de preuves de ces dits abus, les travailleurs seront tenus de prendre d&rsquo;autres dispositions pour s\u2019acquitter de leurs obligations familiales avant de demander un cong\u00e9. Qui cela aide-t-il exactement?<\/p>\n<p>Le gouvernement f\u00e9d\u00e9ral cause peut \u00eatre le plus grand tort aux travailleurs qui fuient la violence familiale. On requiert des salari\u00e9s qui demandent un cong\u00e9 de fournir des documents et le gouvernement f\u00e9d\u00e9ral estime que c\u2019est possible sans \u00eatre intrusif. La violence familiale est par nature \u00e0 la fois priv\u00e9e et personnelle, et la divulgation d\u2019informations sous une forme document\u00e9e r\u00e9v\u00e8le invariablement des d\u00e9tails priv\u00e9s sur la vie de quelqu\u2019un.<\/p>\n<p>En fait, les employeurs ont le droit d\u2019obtenir de la documentation pour toute demande de cong\u00e9, quel qu\u2019en soit le type, ce qui constitue une intrusion injustifi\u00e9e dans la vie du travailleur.<\/p>\n<p>Si les dispositions ne sont pas suffisamment dilu\u00e9es, ajoutez \u00e0 la liste la d\u00e9finition large \u00ab d\u2019\u00e9v\u00e9nement impr\u00e9visible \u00bb qui doit \u00eatre d\u00e9termin\u00e9e par l\u2019employeur. Si les dispositions n\u2019\u00e9taient pas suffisamment dilu\u00e9es, ajouter \u00e0 la liste la d\u00e9finition large du terme \u00ab \u00e9v\u00e9nement impr\u00e9visible \u00bb de la division 1 de la partie III du code. Le concept n\u2019est pas seulement d\u00e9fini au sens large, il est \u00e9galement laiss\u00e9 \u00e0 la discr\u00e9tion de l\u2019employeur de d\u00e9terminer si un \u00e9v\u00e9nement est \u00ab impr\u00e9visible \u00bb.Cette d\u00e9termination laisse une grande marge de man\u0153uvre \u00e0 ce dernier pour contourner les nouveaux droits propos\u00e9s dans le cadre de l&rsquo;initiative de modernisation.<\/p>\n<p>Moderne? Pas vraiment. Une insulte aux travailleurs? Une insulte au mouvement syndical? Absolument.
