{"id":16565,"date":"2020-06-24T09:38:07","date_gmt":"2020-06-24T09:38:07","guid":{"rendered":"http:\/\/www.iamaw.ca\/?p=16565"},"modified":"2026-02-13T09:45:55","modified_gmt":"2026-02-13T09:45:55","slug":"droit-federal-de-refuser-un-travail-dangereux","status":"publish","type":"post","link":"https:\/\/iamunion.kinex12.com\/fr\/droit-federal-de-refuser-un-travail-dangereux\/","title":{"rendered":"DROIT F\u00c9D\u00c9RAL DE REFUSER UN TRAVAIL DANGEREUX"},"content":{"rendered":"<p><strong>DROIT F\u00c9D\u00c9RAL DE REFUSER UN TRAVAIL DANGEREUX<br \/>\n<\/strong><strong>{Code canadien du travail, art. 122, 128, 129, 146, 147}<\/strong><\/p>\n<h3 style=\"text-align: center;\"><a href=\"http:\/\/www.iamaw.ca\/wp-content\/uploads\/2020\/06\/le-droit-de-refuser-un-travail-dangereux.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">T\u00e9l\u00e9chargez le PDF<\/a><\/h3>\n<p><strong>FICHE D\u2019INFORMATION SUR LA SANT\u00c9 ET LA S\u00c9CURIT\u00c9<\/strong><\/p>\n<p><strong>Danger <\/strong>est d\u00e9fini dans le Code comme tout danger, condition ou activit\u00e9 qui pourrait vraisemblablement constituer une menace imminente ou grave pour la vie ou la sant\u00e9 d\u2019une personne qui y est expos\u00e9e avant que le danger ou l\u2019activit\u00e9 ne puisse \u00eatre corrig\u00e9 ou modifi\u00e9.<strong> {s.122}(1)}<\/strong><\/p>\n<p>Il est essentiel que les travailleurs et les autres parties en milieu de travail suivent les \u00e9tapes de refus de travail d\u00e9crites \u00e0 l\u2019article 128 du <strong>Code<\/strong> (ou la convention collective).<\/p>\n<p><strong>En tant que travailleur :\u00a0<\/strong>Vous avez le <strong>droit de conna\u00eetre<\/strong> tout danger potentiel dans votre lieu de travail et le devoir d\u2019informer votre superviseur de tout danger dont vous \u00eates au courant;<\/p>\n<p>Vous avez le <strong>droit de participer<\/strong>, par l\u2019interm\u00e9diaire de votre comit\u00e9 mixte de sant\u00e9 et de s\u00e9curit\u00e9 ou de votre repr\u00e9sentant, au processus d\u2019identification des dangers et de recommandation de mesures visant \u00e0 \u00e9liminer ou \u00e0 pr\u00e9venir les expositions dangereuses;<\/p>\n<p>Tout travailleur assujetti \u00e0 la partie II du Code canadien du travail (le Code) a le <strong>droit de refuser<\/strong> un travail dangereux s\u2019il a des motifs raisonnables de croire qu\u2019il pr\u00e9sente un danger pour lui-m\u00eame ou un autre travailleur.<\/p>\n<p>Il existe des restrictions au droit de refuser de travailler pour certains travailleurs. <strong>{s.128 (2-5)}<\/strong><\/p>\n<p>Les travailleurs ne peuvent refuser d\u2019utiliser ou de faire fonctionner une machine ou une chose, de travailler dans un lieu ou d\u2019effectuer une activit\u00e9 si\u00a0:<\/p>\n<p><strong>Le refus met directement en danger la vie, la sant\u00e9 ou la s\u00e9curit\u00e9 d\u2019une autre personne, ou le<\/strong> <strong>danger est une condition normale d\u2019emploi {par. 128(2)}<\/strong><\/p>\n<p>Mesure disciplinaire<\/p>\n<p><strong>Pas de repr\u00e9sailles<\/strong><\/p>\n<p>Il est ill\u00e9gal pour les employeurs de cong\u00e9dier, de suspendre, de mettre \u00e0 pied ou de r\u00e9trograder, d\u2019imposer une sanction p\u00e9cuniaire ou autre, de prendre des mesures disciplinaires ou de menacer un travailleur d\u2019exercer ses droits ou fonctions en vertu du <strong>Code. [art. 147]<\/strong><\/p>\n<p><strong>D\u00e9claration d\u2019un refus {art. 128(6-7}<\/strong><\/p>\n<p>Le travailleur qui refuse avise imm\u00e9diatement l\u2019employeur.\u00a0S\u2019il existe un libell\u00e9 de refus dans une convention collective, le travailleur doit informer l\u2019employeur s\u2019il refuse en vertu de la convention collective ou du Code.<\/p>\n<p>Le libell\u00e9 de l\u2019entente doit pr\u00e9voir des protections pour les travailleurs qui atteignent ou d\u00e9passent les minimums pr\u00e9vus par le Code.<\/p>\n<p><strong>Enqu\u00eate sur un refus [art. 128 (7.1 et 8)]\u00a0<\/strong>L&#8217;employeur enqu\u00eate imm\u00e9diatement<\/p>\n<p>la pr\u00e9sence du travailleur qui refuse et doit pr\u00e9parer un rapport \u00e9crit. Si l\u2019employeur prend des mesures imm\u00e9diates pour prot\u00e9ger les travailleurs, il doit en informer le comit\u00e9 du travail ou le repr\u00e9sentant de la sant\u00e9 et de la s\u00e9curit\u00e9 au travail. S\u2019il est r\u00e9solu, le travailleur qui a refus\u00e9 retourne au travail.<\/p>\n<p><strong>Poursuite de l\u2019enqu\u00eate interne sur le refus\u00a0<\/strong><strong>\u00a0[art.128(9-14)] <\/strong><\/p>\n<p>S\u2019il n\u2019est pas r\u00e9solu et que le travailleur a toujours des motifs raisonnables de croire que le travail pr\u00e9sente un danger, il doit de nouveau signaler les circonstances \u00e0 l\u2019employeur et \u00e0 un membre du comit\u00e9 ou \u00e0 un repr\u00e9sentant.\u00a0Un travailleur et un membre de l\u2019employeur du comit\u00e9 ou du repr\u00e9sentant du lieu de travail doivent alors enqu\u00eater sur la question en pr\u00e9sence de l\u2019employ\u00e9 qui refuse et pr\u00e9senter un rapport \u00e9crit, y compris des recommandations, \u00e0 l\u2019employeur.<\/p>\n<p>Apr\u00e8s avoir re\u00e7u le rapport, l\u2019employeur peut fournir des renseignements suppl\u00e9mentaires et leur demander de r\u00e9examiner leur rapport.\u00a0Ils peuvent alors choisir de r\u00e9viser et de pr\u00e9senter de nouveau le rapport.\u00a0Si l\u2019employeur reconna\u00eet l\u2019existence d\u2019un danger, il doit prendre des mesures imm\u00e9diates pour prot\u00e9ger les travailleurs.\u00a0S\u2019il est r\u00e9solu, le travailleur qui a refus\u00e9, retourne au travail.<\/p>\n<p>L\u2019employeur doit informer le comit\u00e9 du travail ou le repr\u00e9sentant du travailleur des mesures prises pour r\u00e9soudre le probl\u00e8me.\u00a0Si l\u2019employeur estime qu\u2019aucun danger n\u2019existe ou que le travailleur ne peut refuser de travailler parce que le refus met directement en danger la vie, la sant\u00e9 ou la s\u00e9curit\u00e9 d\u2019un autre travailleur ou que le danger est une condition normale d\u2019emploi, il doit en informer le travailleur par \u00e9crit.<\/p>\n<p><strong>Refus continu -Ministre du Travail avis\u00e9<\/strong><\/p>\n<p><strong>[art.128(15 et 16)]<\/strong><\/p>\n<p>Si le travailleur continue de refuser, l\u2019employeur en avise imm\u00e9diatement le ministre et le comit\u00e9 au travail ou le repr\u00e9sentant des travailleurs. \u00a0L\u2019employeur doit fournir les rapports sur la question au ministre.\u00a0L\u2019employeur peut affecter le travailleur \u00e0 un autre travail raisonnable.\u00a0L\u2019employeur ne peut pas attribuer le travail refus\u00e9 \u00e0 un autre travailleur \u00e0 moins qu\u2019il ne soit qualifi\u00e9, qu\u2019il ne soit inform\u00e9 du refus de travail ou des motifs du refus de travail et que l\u2019employeur ne soit convaincu qu\u2019il ne mettra pas le nouveau travailleur en danger. <strong>[par.129 (5)]<\/strong><\/p>\n<p><strong>Participation du ministre [par. 129(1-7)]<\/strong><\/p>\n<p>Le ministre ou un d\u00e9signer, un agent de sant\u00e9 et de s\u00e9curit\u00e9 qui, dans bien des cas, est cens\u00e9 d\u00e9cider qu\u2019aucune enqu\u00eate n\u2019est requise lorsqu\u2019il est d\u2019avis que la question pourrait \u00eatre trait\u00e9e de fa\u00e7on plus appropri\u00e9e, initialement ou compl\u00e8tement, au moyen d\u2019une proc\u00e9dure pr\u00e9vue aux parties I ou III du Code ou en vertu d\u2019une autre loi f\u00e9d\u00e9rale;\u00a0l\u2019affaire est futile, frivole ou vexatoire;\u00a0ou le refus continu du travailleur en vertu du paragraphe <strong>128(15)<\/strong> est de mauvaise foi. <strong>[par.129(1)].<\/strong> Le ministre informe l\u2019employeur et le travailleur par \u00e9crit d\u00e8s que possible et le travailleur doit retourner au travail.\u00a0L\u2019employeur doit ensuite informer par \u00e9crit les membres du comit\u00e9 local ou les repr\u00e9sentants du travailleur et de l\u2019employeur d\u00e9sign\u00e9s en vertu du paragraphe <strong>128(10)<\/strong> de la pr\u00e9sente d\u00e9cision. Si une enqu\u00eate est entreprise, elle doit \u00eatre men\u00e9e en pr\u00e9sence de l\u2019employeur, du travailleur et du membre du comit\u00e9 ou du repr\u00e9sentant du lieu de travail. Le ministre rend imm\u00e9diatement une d\u00e9cision \u00e9crite \u00e0 l\u2019employeur et au travailleur pour lui demander soit de retourner au travail, soit de prendre des mesures pour prot\u00e9ger les travailleurs.
