Au cours des derni\u00e8res semaines, de nombreux employeurs ont publi\u00e9 des politiques de vaccination obligatoire, suscitant de multiples pr\u00e9occupations, allant des droits individuels aux droits du collectif pour travailler dans des environnements s\u00fbrs. Certains soul\u00e8vent des pr\u00e9occupations pratiques, comme l\u2019indemnisation des accidents du travail, et la question de savoir si les employeurs qui exigent des vaccins sont responsables des travailleurs qui d\u00e9veloppent des r\u00e9actions graves et ind\u00e9sirables.<\/p>\n<p>La question de cette r\u00e9ponse se trouve dans les r\u00e9gimes d\u2019indemnisation des travailleurs. \u00c0 l\u2019\u00e9chelle du Canada, les organismes d\u2019indemnisation des accident\u00e9s du travail reconnaissent que, dans certains cas, les cas li\u00e9s \u00e0 la COVID-19 sont li\u00e9s au travail et, par cons\u00e9quent, indemnisables. De m\u00eame, les organismes d\u2019indemnisation des accident\u00e9s du travail reconnaissent que dans les cas o\u00f9 un employeur exige un vaccin, en recourant \u00e0 une forme quelconque de coercition, comme un cong\u00e9 sans solde ou un cong\u00e9diement pour encourager la vaccination, les employeurs peuvent \u00eatre responsables. Les travailleurs ayant des r\u00e9actions graves, une norme d\u00e9finie par le r\u00e9gime d\u2019indemnisation de chaque travailleur, peuvent faire approuver leur demande d\u2019indemnisation. Chaque administration d\u00e9crit ce qui constitue une r\u00e9action grave et ce que la vaccination obligatoire implique dans le contexte du travail. Il est donc important que les membres comprennent les seuils dans leur province.<\/p>\n<p>En Ontario, la Commission de la s\u00e9curit\u00e9 professionnelle et de l\u2019assurance contre les accidents du travail d\u00e9finit une r\u00e9action grave comme suit\u00a0:<\/p>\n<p><strong><em>\u00ab\u00a0Un effet ind\u00e9sirable est une r\u00e9action grave et inattendue \u00e0 un vaccin. Si la r\u00e9action n\u00e9cessite un traitement m\u00e9dical au-del\u00e0 des premiers soins et\/ou une absence du travail de plus de quelques jours. Cela indique que la r\u00e9action \u2013 en termes de gravit\u00e9 et\/ou de dur\u00e9e \u2013 est all\u00e9e au-del\u00e0 des r\u00e9actions b\u00e9nignes courantes attendues de la vaccination (fi\u00e8vre, frissons, douleur au point d\u2019injection, fatigue et maux de t\u00eate qui devraient se r\u00e9soudre d\u2019eux-m\u00eames en quelques jours).\u00a0\u00bb<\/em><\/strong><\/p>\n<p>Les travailleurs devraient \u00e9galement prendre note d\u2019un programme f\u00e9d\u00e9ral visant \u00e0 aider les personnes qui \u00e9prouvent une r\u00e9action grave \u00e0 l\u2019un des vaccins approuv\u00e9s.\u00a0Le Programme de vaccination en cas de blessure est ind\u00e9pendant de tout organisme d\u2019indemnisation des accidents du travail et les demandes sont trait\u00e9es de fa\u00e7on ind\u00e9pendante.\u00a0Pour les r\u00e9sidents du Qu\u00e9bec, un programme distinct est offert, qui s\u2019applique non seulement aux personnes ayant des r\u00e9actions graves aux vaccins contre la COVID-19, mais aussi \u00e0 tout autre vaccin recommand\u00e9 par le gouvernement.<\/p>\n<p>Alors que le virus continue de muter, de nouvelles informations \u00e9mergent sur sa contagiosit\u00e9 et ses effets.\u00a0\u00c9tant donn\u00e9 que les effets \u00e0 long terme du virus sont inconnus, les personnes dont le test est positif devraient d\u00e9poser une demande dans leur province ou territoire, m\u00eame si la demande est rejet\u00e9e.\u00a0Si les sympt\u00f4mes de la COVID-19 persistent ou si des complications surviennent qui rendent difficile la poursuite du travail, la preuve d\u2019une demande initiale sera utile lorsque vous en d\u00e9poserez une deuxi\u00e8me.\u00a0Le temps d\u2019absence du travail en raison de la COVID-19 peut \u00eatre consid\u00e9r\u00e9 comme une blessure, et il est recommand\u00e9 qu\u2019une personne pr\u00e9sente une demande.<\/p>\n<p>Enfin, les employeurs sont tenus non seulement de signaler les cas de COVID-19 \u00e0 une agence de sant\u00e9 publique de leur r\u00e9gion, mais aussi de signaler les cas au minist\u00e8re du Travail, s\u2019ils rel\u00e8vent de la comp\u00e9tence provinciale, et au Programme du travail, s\u2019ils rel\u00e8vent de la comp\u00e9tence f\u00e9d\u00e9rale.<\/p>\n<p>Le fait de conna\u00eetre vos droits vous permettra d\u2019assurer votre s\u00e9curit\u00e9, celle de vos coll\u00e8gues et celle de votre collectivit\u00e9.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dans une course contre la quatri\u00e8me vague du coronavirus, le gouvernement, les bureaux de sant\u00e9 publique et les employeurs sont pass\u00e9s de l\u2019encouragement \u00e0 la vaccination \u00e0 l\u2019obligation.
